• Submit equipment quote requests
• Manage team members and account settings

3. Account Registration and Security

To use the Portal, you must be at least 18 years old and have the authority to bind your organization to these Terms. The Portal is intended for business use by existing or prospective customers of EQUIPMENT GIANT INC..

To access the Portal, you must register using a valid email address associated with your business relationship with EQUIPMENT GIANT INC.. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

Quotes provided through the Portal are valid for the period specified in the quote. Prices, availability, and terms are subject to change without notice until a binding contract is executed.

5.3 Contracts

All equipment purchases, rentals, and services are governed by the specific terms and conditions contained in the applicable contract or agreement. In the event of any conflict between these Terms and a specific contract, the terms of the specific contract shall prevail.

6. Payments and Billing

7. Intellectual Property

The Portal and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, and software) are owned by EQUIPMENT GIANT INC. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Portal for your internal business purposes. You may not copy, modify, distribute, sell, or lease any part of the Portal without our prior written consent.

You acknowledge that through your use of the Portal, you may have access to confidential business information, including pricing, product availability, and contract terms. You agree to maintain the confidentiality of such information and not disclose it to third parties without our prior written consent.

9. Disclaimer of Warranties

THE PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PORTAL WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE PORTAL.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQUIPMENT GIANT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PORTAL.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNTS YOU HAVE PAID TO EQUIPMENT GIANT INC. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless EQUIPMENT GIANT INC. and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Portal or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Portal at any time, with or without cause and with or without notice. Upon termination, your right to use the Portal will immediately cease, but these Terms will continue to apply to your past use of the Portal.

You may terminate your account at any time by contacting us at clients@equipmentgiant.com. Termination of your Portal account does not affect any existing contracts or obligations with EQUIPMENT GIANT INC..

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Portal shall be resolved exclusively in the state or federal courts located in Seminole County, Florida.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and any specific contracts or agreements between you and EQUIPMENT GIANT INC., constitute the entire agreement regarding your use of the Portal and supersede any prior agreements or understandings.
